Heirs of Isaac J. Dawson as Nonresidents of Indiana: Elizabeth Webb of Illinois and Nancy & Isaac Kyle of Ohio.

Heirs-at-law of Isaac J. Dawson: Daniel Dawson of Wabash Co Ind. & William Dawson of Marshall Co Ind. Neither Daniel Dawson nor William Dawson was found to live in Indiana.

Complaint.  Be if remember that on the 13th day of June  A.D. 1853 the Plaintiff by M.E. Doughtery,  attorrney, filed the following Complaint in the Clerk's Office of the Circuit Court of Kosciusko County.

John Bridenstine versus Andrew J. Dawson, Melissa Ann Dawson, George W. Dawson, Frances A. Dawson, Isabella Dawson, Aaron & Mary Rose, Elizabeth Webb, Isaac & Nancy Kyle, Daniel Dawson & William Dawson

September Term A.D. 1853. John Bridenstine complains of above named defendants. On Oct 5, 1851, Isaac Dawson was seized in fee simple of 16 acres of land lying in the west end of the south half of the S.W. Quarter, Section 2 Twp, thirty-two north of Range 5 East in Kosciusko Co Ind.

Isaac Dawson on 4th Oct 1850 executed & delivered to Joseph Dawson an obligation under seal by which he promised on 20th of April 1852 to pay or cause to be paid the sum of $80 to the said Joseph Dawson which might be discharged with 16 a. of land lying in the west end of the south half of the s.w. quarter of section 2.

Joseph Dawson on 3rd Nov 1852 in consideration of $100 to him paid assigned the same instrument in writing to the plaintiff & delivered the same to him; also to said Plaintiff an instrument in writing by which he bound himself to cause said Plaintiff a deed for the said tract of land above described. Isaac Dawson of the said instrument in wirting by him to be executed became due.

Heirs-at-law: deed within having been paid & discharged to the said Andrew J. Dawson, Melissa Ann Dawson, Geo. W. Dawson, Francis A. Dawson, infants under the age of 21 residing in Kos. Co; and Elizabeth Webb who resides in the state of Illinois, and Nancy Kyle, wife of Isaac Kyle, who resides in state of Ohio, and *Daniel Dawson of Wabash Co Ind. and William Dawson of Marshall Co, Ind.

To the Sheriff of Kosciusko Co Ind. & Wabash Counties: Convey summons to Andrew J. Dawson, Melissa Ann Dawson, Geo. W. Dawson, Francis Dawson, Isabella Dawson, Aaron & Mary Rose, Elizabeth Webb, Isaac & Nancy Kyle.  David Dawson & William Dawson to appear in Kos. Circuit Court on the 1st day of next term to answer complaint.

13th day of June, 1853: Samuel H. Clipman, Clerk, said Note on back (of Complaint) was endorsed June 21, 1853, by Daniel Dawson for balance, but he was not found in Wabash County. Signed by Barry Parker, Sheriff.

To Sheriff of Marshall Co Ind: Andrew J. Dawson, Melissa Dawson, Geo. W. Dawson, Francis J. Dawson, isabella Dawson, Aaron & Mary Rose, Elizabeth Webb, Isaac & Nancy Kyle, Daniel Dawson & Wm Dawson to answer complaint of John Bridenstine due June 13, 1853. J. D. Thompson, Sheriff.

The following executors were informed: Andrew J. Dawson by copy July 1, 1853. Melissa Ann Dawson, Geo. W. Dawson, Francis A. Dawson, Isabella Dawson by reading July 1, 1853. Other defendants not found in my balliwick: signed N. McGree, Sheriff of Kos. Co Ind. 

July 2, 1853. At Court in Warsaw, Kos. Co Ind. Proceedings: Civil Action by John Bridenstine vs. Andrew J. Dawson et. al. It is by affadavit this day filed in my office that Elizabeth Webb, Isaac & Nancy Kyle are non-resident of the state of Indiana. Further Notice was published in Warsaw Democrat 16 to 30 day of June till July 7, 1853. Proved to satisfaction of the Court that Elizabeth Webb, Isaac & Nancy Kyle, non-resident defendants on this day were served by publication. All other defendants have been legally served with process three times, viz. Andrew J. Dawson, et. al.

Therefore, the Court appoints William Williams *Guardian of said Infant Defendants who will in open court accept said appointment as granted by said defendants.
